On the Shudra Varna

The Shudras were the class of people in Indian society who were involved in various occupations such as:

Engineering (nagaravAstushilpi) — civil works such building roads, bridges, dams, reservoirs, wells, etc
Metal works (karmakAra orkarmAra) — ore-smelting, smithy, forging, manufacturing of weapons, agricultural implements, vessels, etc
Pottery (kumbhakAra orkulAla) — all kinds of vessels and containers as well as other public monuments
Carpentry (takShaka, sthapati)
Weaving (paTakAra orsUtrakAra or tantuvAya) — all kinds of clothing manufacture
Construction (gRhavAstushilpi) — houses, temples, and other buildings
Cart-building & chariot-building (rathakAra)

So, you can clearly see that civilized urban life would not have been possible in ancient India without the irreplaceable contribution of Shudras. Every other community in society, including Brahmins, depended on Shudras for basics of everyday life.

So, it is illogical and unimaginable that Shudras would be actually oppressed because it is much easier for Shudras to boycott the rest of society if they thought they were being oppressed. Besides, Shudras always formed more than 75% of the population at any time in history, whereas Brahmins formed 5% or less. So, it is much easier for Brahmins to face actual oppression even though it may appear that they had all the power just because they wrote all the books that have come down to us.

It has become a common theme in modern times to selectively read through different kinds of traditional scriptures, and come to grossly erroneous and ill-informed conclusions about alleged atrocities or discrimination or denigration such as the question frames it.

The fundamental categorization of Hindu scriptures is in terms of shruti and smRti. The shruti texts are the Vedas, which are descriptive texts. This means they describe things as they really were. So they describe society and the different classes of people and their interactions as it really was. The smRti texts are prescriptive texts. This means these are various texts of individual authors who wrote their personal opinion of how things should be in their time. These are framed as “laws” and the texts can be called “law books” in modern parlance.

So, with this fundamental definition in mind, it is highly unintelligent to imagine that every single “law” written in these “law books” were actually implemented in practice without knowledge of how ancient Indian society was organized.

Caste-level organization had more power over people of the caste than the king or the theoretical law books written by Brahmins. More often than not, the caste elders were the representatives and spokespeople for the caste, and they negotiated power and influence with other communities and the state. This dynamic is seen throughout history as different castes rise and fall in their social status and power depending on changing conditions and needs of society.

Often, in the case of various Shudra communities, new technological developments changed the landscape of occupations, where one community’s traditional occupation is lost or taken over by another, thus causing a fall in the status of the first community and a rise in the status of the second.

For example, when earthenware was in high demand, potter community was highly respected. In fact, many of the Vedic metaphors use a potter’s wheel as the imagery for Brahman creating the world just as a potter creates pots from clay. When metallurgy began to advance, and more metal products began to be used, potters became secondary, and blacksmiths and smelters rose up in social status and importance. Clothes were always in demand, and so weavers were always held in high esteem.

First, let us look at how the Shudras are described in the shruti. In the Taittiriya Samhita 4.5 (which is famously known as Rudradhyaya or Rudra Namakam), the various Shudra occupations are mentioned as being forms of the supreme god Shiva himself:

(4.11) नमः क्षत्तृभ्यः संग्रहीतृभ्यश्च वो नमः — namah kShattRbhyah samgrahItRbhyashca vo namah — obeisance to teachers of charioteers and to charioteers.

(4.12) नमस्तक्षभ्यो रथकारेभ्यश्च वो नमः — namah takShabhyo rathakArebhyashca vo namah — obeisance to carpenters and cart-makers

(4.13) नमः कुलालेभ्यः कर्मारेभ्यश्च वो नमः — namah kulAlebhyashca karmArebhyashca vo namah — obeisance to potters and blacksmiths

(4.14) नमः पुञ्जिष्टेभ्यो निषादेभ्यश्च वो नमः — namah puñjiShTebhyah niShAdebhyashca vo namah — obeisance to bird-catchers and bird-hunters

(4.15) नम इषुकृद्भ्यो धन्वकृद्भ्यश्च वो नमः — namah iShukRdbhyo dhanvakRdbhyashca vo namah — obeisance to arrow-makers and now-makers

(4.16) नमो मृगयुभ्यः श्वनिभ्यश्च वो नमः — namo mRgayubhyah shvanibhyashca vo namah — obeisance to hunters and dog-owners (i.e. chandalas)

(4.17) नमः श्वभ्यश्च श्वपतिभ्यश्च वो नमः — namah shvabhyashca shvapatibhyashca vo namah — obeisance to dogs and to dog-keepers (i.e. chandalas)

So the Vedas (given to mankind by God,) and have such high respect for Shudras. Tradition says that in any matter if there is a difference of opinion between shruti and smRti, the former overrules the latter. Besides as mentioned above, shruti describes the thing as it really was, whereas smRti prescribes things according to an individual author.

So in reality, on the ground, it is unfair and incorrect to say that “Brahmins used Manusmriti as a tool to against Dalits”. The Manusmriti is a theoretical text book. There are many rules in it that are astounding and nobody would believe that anyone actually did what it prescribed. The rules for Brahmins in Manusmriti are hundred times more strict and severe than those for Shudras. For example, there is no punishment if a Shudra gets drunk, but if a Brahmin gets drunk his punishment is to insert a heated sword down his throat as far as the liquor has gone down.

Now let us look at actual history and see where the Shudras have been — at the “lowest position” as the question says or not.

Here’s a fact — more than 90% of the kings of India were Shudras. Here’s a list of Shudra kings:

Maurya dynasty
- Chandragupta Maurya — the Brahmin Chanakya actually selected him to become king by destroying the Nanda dynasty which was Kshatriya!!!
- Bimbisara (son of Chandragupta Maurya)
- Ashoka (son of Bimbisara)
Chalukya dynasty of Badami — ruled Deccan and south India for 700 years (6th-12th centuries)
- The kings of this dynasty such as Pulakeshi II were great patrons of Vedic religion and the mainstream Hindu culture, art, literature and architecture
Rashtrakuta dynasty — ruled Deccan and south India for nearly 300 years between 8th and 11th centuries
- Once again, the great kings of this dynasty promoted and nurtured classical Hinduism and was also responsible for the exquisitely beautiful cave temples in Ellora (e.g. Kailasanatha Temple)
Chola dynasty — ruled the Tamil country for nearly 350 years (10th-13th centuries)
- Rajaraja and his son Rajendra were great patrons of Hinduism and Vedic religion, and their trade relations with southeast Asia also carried Hinduism and Buddhism to that region.
Vijayanagara empire —
- Famously the Brahmin Svami Vidyaranya chose the Shudras Harihara and Bukkaraya to lead an organized revival of a Hindu empire to thwart the incursion of Islam in south India.
- The second generation king Kumara Kampana rescued the Tamil region from Muslim rule
- Krishnadevaraya continued to strengthen the empire and it became a bastion of classical Hinduism all across India, and attracted scholars, musicians, artists from all over India. Temple architecture developed a new style with the tall imposing “Raya Gopurams” named for the Vijayanagara Kings (“Rayas”).
Chandela dynasty — ruled central India between 9th and 13th centuries
- These kings were of tribalorigin, but established a strong Hindu kingdom and patronized the Vedic religion and all-rounded Hindu culture, arts, music, philosophy, etc
- They built the legendary Khajuraho temple complex
- They were a major resistance against early Muslim invasions of Ghaznavi and Ghori
Gurjara-Pratihara dynasty — ruled over western India between 8th and 12th centuries
Rajput kingdoms — famously valiant and fierce defenders of the western frontier of India and followers and patrons of Hinduism
Maratha empire — Shivaji was a Shudra and he was educated by Samarth Ramdas. Shivaji is famous for a second revival of Hinduism after the fall of Vijayanagara and for bringing the downfall of the Mughal empire and resisting the British takeover of vast parts of India for nearly a century.

Also, until the 18th century, when the traditional education system of India was mostly undisturbed, every village in India had its own public-funded schools, and all children of the village received education. The composition of the children in these schools was 85% Shudras, 5% Brahmins and 10% remaining communities, and equal numbers of boys and girls. The present-day downfall of some Shudra communities can be traced back to the British policies of destroying indigenous industries so that British-produced goods could be sold back to Indians at exorbitant prices after stealing raw materials from India at dirt-cheap prices. This was also why Gandhiji started the Swadeshi Movement of making goods in India and wearing only Khadi.

The British census created a huge turmoil in the way Indians saw themselves. Prior to the first British census, various communities did not see themselves in a hierarchy. The British actually forced different communities into a strict hierarchy based on their utter misunderstanding of the complex Indian society, and thus forcefully placed Shudra communities at the bottom of the hierarchy, despite protests from those communities who saw themselves much higher in social status.

So please understand the complex effect of foreign interference on “caste discrimination” instead of ignorantly blaming Brahmins for everything.

Viewpoint: How the British reshaped India’s caste system

“WR Cornish, who supervised census operations in the Madras Presidency in 1871, wrote that “… regarding the origin of caste we can place no reliance upon the statements made in the Hindu sacred writings. Whether there was ever a period in which the Hindus were composed of four classes is exceedingly doubtful”.

Similarly, CF Magrath, leader and author of a monograph on the 1871 Bihar census, wrote, “that the now meaningless division into the four castes alleged to have been made by Manu should be put aside”.

Anthropologist Susan Bayly writes that “until well into the colonial period, much of the subcontinent was still populated by people for whom the formal distinctions of caste were of only limited importance, even in parts of the so-called Hindu heartland… The institutions and beliefs which are now often described as the elements of traditional caste were only just taking shape as recently as the early 18th Century”.

In fact, it is doubtful that caste had much significance or virulence in society before the British made it India’s defining social feature.”

तूफान आने से पहले की खामोशी सभी देशवासियों को समझ जाना चाहिए

धारा 370 का हटना यकीनन बहुत खुशी की बात है,

मगर लङाई अभी खत्म नहीं हुई है, बल्कि इसके साथ ही एक अंतहीन संघर्ष की शुरूआत भी हुई है, जिसे आम आदमी नहीं देख पा रहा है। देश का अधिकाँश मुसलमान गुस्से से उबल रहा है और बदले व खून खराबे की फिराक में है, ये पक्की खबर है।

हालांकि सरकार को भी इसकी पक्की खबर है और वो हर पल चौकन्नी भी है। हमारी पक्की खबर का सबसे पुख्ता सबूत ओवैसी का वो भाषण है, जो कुछ दिन पहले ही सामने आया था, जिसमें वो खुले आम ये कहकर भारत सरकार को धमका रहा था कि “कश्मीर के मुसलमान बहुत समझदार हैं, वो किसी भो बात का बदला तुरंत नहीं लेता। सन 87 के घटनाक्रम का बदला उन्होंने सन 89 में हिन्दुओं की कत्लोगारत करके लिया और पूरी कश्मीर घाटी को हिन्दू विहीन बना दिया”।

ओवैसी की इस लाइन को अगर बारीकी से समझा जाये तो देश के हिन्दुओं को खुलेआम धमकी और चेतावनी है कि जो 89 में कश्मीर में हुआ वो देश में भी हो सकता है।

अतः ओवैसी के इस बयान को उसका बड़बोलापन न समझो, बल्कि सभी हिन्दुओं को हर पल व हर हाल में एकजुट और चौकन्ना रहने की सख्त आवश्यकता है। कुल मिलाकर कहना ये चाहता हूं कि खुशियाँ बहुत मन गयीं, अब वक्त है एक आँख खोलकर सोने का।

ये सच है कि हिन्दू आज पहले की तुलना में एकजुट हुआ है, मगर जितनी जरूरत है, उससे बहुत कम है। यही मेरी चिंता का असली कारण भी है। हमारे देश में मीर ज़ाफरों और जयचंदों की कमी नहीं है। आइये सांकेतिक रूप में पहले आपका उनसे ही परिचय करा दू।

(1) बिहार का एक पलटूराम आजकल बहुत करारी खिचड़ी पका रहा है। वो जानता है कि अगली बार उसका आना लगभग असंभव है, क्योंकि मेरे अनुमान के मुताबिक हमारे चाण्क्य महाराष्ट्र style में बिहार का चुनाव लड़ेंगे, जिसमें उसका हारना 90% तय समझिये .

अतः कुरसी की खातिर वो पाकिस्तान से भी हाथ मिला ले तो आश्चर्य मत करना। इस शक का पहला सबूत ये कि भाजपा के बढ़ते जनाधार को रोकने के लिये उसने चुनाव specialist के नाम से मशहूर PK को ममता के पास कुछ महीने पहले भेजा है। PK नौटंकी कराने में बहुत माहिर है जैसे चाय पे चर्चा, खाट सभा, असहिष्णुता गैंग बनाना, अवार्ड वापिसी गैंग तैयार कर भाजपा को बदनाम करना आदि उसी के दिमाग की उपज थीं। बंगाल में पहुंचकर एक मुस्लिम अभिनेत्री को कोरी दुल्हन बनाकर जमकर सुर्खियाँ बटोरीं। मकसद था चाणक्य के प्रभाव को कम करना, ये और बात है कि इस नौटंकी ने अभिनेत्री को भले ही प्रिया प्रकाश की तरह मशहूर कर दिया, मगर आज वही खूबसूरत भैंस पानी में समाती नज़र आ रही है।

पलटूराम के जयचंदीय लक्षण का दूसरा सबूत ये है कि NDA में होते हुए भी उसने तीन तलाक और धारा 370 पर भाजपा का साथ नहीं दिया, जबकि उन दलों ने साथ दे दिया जो NDA में नहीं थे, जैसे बसपा, नवीन पटनायक, दिल्ली वाले घुघरू सेठ जिसकी बाल बराबर उम्मीद नहीं थी, मगर दुशासन बाबू ने पीठ दिखा दी। हम में से किसी ने जयचंद को नहीं देखा, क्योंकि उस समय हमारा दुनिया में अस्तित्व ही नहीं था, मगर हम खुशनसीब हैं कि आज दुशासन बाबू के रूप में हमें जयचंदजी के साक्षात दर्शन हो रहे हैं।

(2) लाल सलाम उर्फ वामपंथ। भले ही राजनैतिक तौर पर फिलहाल इनकी कोई औकात नहीं है, मगर मत भूलिये कि मीडिया और न्याय के मंदिर में आज भी इनका जूता पुजता है।

हिन्दू पहले की तुलना में होशियार जरूर हुआ है, मगर उतना ही जितना LKG का बच्चा UKG में आकर हो पाता है, जो आज की चुनौतियों के आधार पर “ऊँट के मुह में जीरे” के बराबर ही है।

इसका सबूत ये कि आजतक की एक प्रेस्या विधायक की बेटी की आशिकी की नुमाइश कर रही थी और लोग चटखारे लेकर देख रहे थे। उन्हें समझ ही नहीं आया कि उस कुख्यात प्रेस्या का असली मकसद लड़की को उसका प्यार दिलाना नहीं, बल्कि मदरसे में पकड़े गये हथियारों की खबर से लोगों का ध्यान भटकाना था, ताकि लोग आतंकवाद और आतंकवादी समाज की कारगुजारियों की चर्चा न कर सकें।

(3) भले ही खान्ग्रेस आज अपने बुरे दौर से गुजर रही है मगर एक कड़वा सच ये भी है कि इसके कई फुस्स फटाखे आज भी देश में तबाही ला सकते हैं। चिदंबरम, आशिकी 70+ उर्फ टंच माल, अहमद पटेल, गुलामे पाकिस्तान, बाटला हाऊस के बाद अपनी खान्ग्रेसी राजमाता द्वितीय के आँसू गिनने वाला सलमान खान, ससुरेवाला…. आदि। इस पार्टी में तो गद्दारों की भरमार है। अतः खत्म होती खान्ग्रेस को देखकर चादर तानकर सोना आत्महत्या करने के बराबर ही होगा। समझदार लोग दुश्मनों की अंतिम चल रही साँसों को देखकर निश्चिंत कभी नहीं होते, बल्कि तब होते हैं जब तक कि अपने हाथों से दुश्मन को कब्र में नहीं गाड़ देते। उसके बाद भी उसकी कब्र पर एक पौधा रोप देते हैं, ताकि पानी देने के बहाने देखते रहें कि मुर्दे कब्र में ही हैं न!!

मत भूलो कि ये वही खान्ग्रेस है, जिसने हिन्दू आतंकवाद या भगवा आतंकवाद जैसा शब्द गढ़ा था, जो 89 के कश्मीर में हुए हिन्दुओं के नर-संहार पर मूक दर्शक बनी रही थी, जिसने नसबंदी का आतंक फैलाया और शिकार सिर्फ हिन्दुओं को ही बनाया, जिसने 84 में सिखों का नरसंहार कराया, जिसने साध्वी पर भयानक अत्थाचार कराये, जिसने सन 66 में 500 से ज्यादा गौ-भक्त साधुओं को मौत के घाट उतारा…. ऐसे अनगिनत कुकर्मों से सुसज्जित खान्ग्रेस सिर्फ इस ताक में है कि हिन्दू जरा सा भटके और ये देश को शमशान बना सकें।

(4) पाक ने गज़वा ऐ हिंद और कश्मीर के लिये स्वयं को बर्बाद कर लिया अतः आपको लगता है कि वो खामोश बैठेगा? घायल दुश्मन, अगर वो मुसलमान है तो नागिन से भी ज्यादा खतरनाक होता है। नागिन का बदला चूक सकता है, मगर घायल मुसलमान का कभी नहीं। मत भूलिये कि ऐंटोनियो माइनो पूर्व KGB की ऐजेंट भी रह चुकी है। उसके यू तो अनगिनत किस्से सुर्खियों में रहे हैं मगर एक किस्सा कम सच्चाई पूरे शरीर में सिहरन पैदा कर देती है। हर पल साये की तरह राजीव के साथ रहने वाली ऐंटोनियो राजीव के जीवन की अंतिम सभा में साथ नहीं थी, क्यों? जरा सोचिये इस क्यों के पीछे कितनी भयावह सच्चाई छुपी होगी। ऐंटोनियो ने अपने शासनकाल के दौरान हमेशा मोदीजी और अमित शाह को ही निशाने पर रखा, जबकि भाजपा में और भी वरिष्ठतम नेता थे क्यों? संघ में से सिर्फ मोहन भागवतजी को ही निशाने पर लेने की पूरी योजना बनाई, जबकि संघ तो बहुत बड़ा है। सवाल ये कि क्यों?? ये कड़वे सच उसके दिमाग की गहराई और दूरदर्शिता को भी प्रदर्शित करते हैं।

आज इतने बड़े ऑपरेशन (370 हटने) के बाद भी घाटी और देश में शांति है वो इस बात का सबूत है कि सरकार ने इसके लिये महीनों पहले हर बारीकी पर कितना परिश्रम किया था। सरकार 24×7 Active mode में चल रही है और किसी भी देशद्रोही की दाल नहीं गल पा रही है या ये भी हो सकता है कि ये तूफान से पहले की खामोशी हो?? सच जो भी हो मगर हर सच ये कहता है कि हिन्दुओं की जरा सी बेवकूफी उनके और देश के लिये नरक के द्वार खोल देगी। देश के कोने कोने में 500+मिनी पाकिस्तान बने हैं जो एक इशारे पर तूफान ला सकते हैं। उस तूफान को सिर्फ हिन्दुओं की एकता ही रोक सकती है।

The Sikh Gurus have inspired us in an era that was perhaps the most challenging phase of our history. Sikhism represents a tradition that every Indian is proud of. One cannot forget the contributions of Sikh Gurus and their selfless sacrifices to consolidate the society, provide them direction and overthrow the rule of invaders. That is why the Sikh Gurus are revered not only by Sikhs but all nationalists in general as role models.

The medieval era represents the darkest phase of our society. Internally we were being eroded by termites of casteism, gender discrimination and overt ritualism dissociated from Vedas. And externally, we were being butchered by a tribe of most uncivilized society of west Asia – read the Ghaznis, Khiljis, Mughals, Slaves, Tughlaqs etc.

The Sikh gurus, in these turbulent times, lit the lamp of Vedic wisdom and steered the society towards the fundamental tenets of our culture – rationalism, actions and compassion.

Often there is dispute over whether Sikhism is part of Hinduism or a separate religion. In our view, this is a meaningless debate. Because the word Hinduism has different connotations. From a western mindset, Hinduism represents a mix of very specific rituals associated with casteism, gender discrimination and idol worship. If this be Hinduism, then Sikhs are definitely not Hindus.

However, if Hinduism is considered to mean the culture that is inspired from the philosophy of Vedas, then perhaps not many sects are more Hindu than Sikhs. Sikhism represents the message of Vedas in simple language of layman.

Let us see what makes Sikhism an extremely pure representation of Vedic wisdom (We shall ignore later day aberrations and focus on the key message of the noble Gurus):

– Sikhism rejects birth-based casteism and believes in equality of all

– Sikhism believes in gender equality

– Sikhism believes in protection of cows because it is one of the most useful gifts of God to humans

– Sikhism believes in actions as means to achieve God. Thus, they reject withdrawal from life.

– Sikhism believes in one single timeless shapeless omnipresent God whose best name is Onkaar (Om + Kaar). This is almost verbatim translation of Yajurveda 40.8.

– Sikhism believes in theory of Karma and rebirth

– Sikhism refuses the concept of Heaven/ Hell and believe in salvation as ultimate goal

– Sikhism believes in Nama Smaran or understanding the names and properties of God as way to achieve Him

– Sikhism considers Maya or ignorance as obstacle to salvation and urges to eradicate it through devotion, noble actions and knowledge

– Sikhism takes it as our utmost duty to fight against injustice of any kind. The lives of Sikh gurus exemplify this.

– Sikhism considers entire humanity as one family and refuses to have different treatments for people of different beliefs and religions.

The list can continue further. Note that if you replace Sikhism in above lines with ‘Vedic Dharma’ you would realize that the points still hold valid.

A great saga of valour and brutality!

: “He is a mad man” – said *Gandhi! * about Udham Singh.

“His act was a senseless deed” – also said *Pundit Nehru! *

“We condemn his act of terror and apologize and hope we are not punished for it”

This resolution was passed by *The Congress Party! *

He was *Shaheed Udham Singh* and the senseless deed he did was that he killed *Michael Dwyer. *

Michael was the *monster* who massacred 1526 innocent unarmed peaceful Indians in *Jalian wala Bagh, Amritsat in 1919.*

Udham singh was a 19 years old volunteer who was serving Water to the 20,000 people gathered in the garden on festival of Baisakhi.

They were brutally massacred by Gen Dwyer and Udham singh was live witness to it.

He wanted to avenge the brutality and get some sense of justice to these martyrs.

British GOVT didn’t take any action.

*Congress couldn’t get British to act on Dwyer.*

So Dwyer happily retired to England and was leading a peaceful rich life.

*Meanwhile, Udham singh joined Gadhar Party and fought for freedom.*

He was jailed for 5 years and there he was inspired by death and martyrdom of *Bhagat Singh* who wanted to take action on Dwyer.

After release, he escaped from India through Kashmir. He went to Germany and then to London.

He joined as engineer and pursued Dwyer for 6 years. He procured a gun, learnt shooting and then found that on 13, March, 1940 Dwyer was speaking in Caxton hall, London.

He hid a gun in a book in which he had carved a place for gun. Sat in front row and shot two bullets into heart and lung of Dwyer.

Dwyer died instantly.

Udham Singh didn’t escape. He bravely courted arrest.

He told these words to the judge:

*”I did it because I had a grudge against him. He deserved it. He was the real culprit. He wanted to crush the spirit of my people, so I have crushed him. For full 21 years, I have been trying to seek vengeance. I am happy that I have done the job. I am not scared of death. I am dying for my country. I have seen my people starving in India under the British rule. I have protested against this; it was my duty. What greater honor could be bestowed on me than death for the sake of my motherland?”*

He was sentenced to death in the court.

He fasted for 42 days in the jail and was brutally tortured and hanged on July 31, 1940

*Meanwhile in India congress condemned his act. Gandhi and Nehru abused him for making British angry and they forced Congress to pass a resolution against killing of Dwyer.*

They were very busy those days helping British recruit Indian soldiers for World War – II and they didn’t want Punjab to get upset with British.

This is our great freedom fighting party which condemned killing of a monster like Dwyer who massacred 1526 people in Punjab.

*Udham Singh was buried in London, and like other freedom fighters he is forgotten in India.*

*No text books talk about him.*

Few people know about him.

*I am happy that they are making a movie on this patriot and coincidentally it will be released on Gandhi ji’s birthday on Oct 2. His story is a great and inspiring one.*

Mayawati named a District in Uttarakhand after him in 1995, perhaps the only good deed she has done in her life and in 1974 his remains were exhumed and brought to Bharat and he was cremated here.

His ashes are in an urn in *Jalian Wala Bagh.*

Let this message be passed to generations next.

Remembered in Japan, forgotten in India……..

The day was 12 November, 1948. Tokyo Trials are going on in a huge garden house on the outskirts of Tokyo, the trial of fifty-five Japanese war criminals including Japan’s then Prime Minister Tojo, after losing WWII.

Of these, twenty-eight people have been identified as Class-A (crimes against peace) war criminals. If proved, the only punishment is the “death penalty”.

Eleven international judges from all over the world are announcing……”Guilty”…. “Guilty”…… “Guilty”……… Suddenly one thundered, “Not Guilty!”

A silence came down in the hallway. Who was this lone dissenter?

His name was Radha Binod Pal a Judge from India.

Born in 1886 in the Kumbh of East Bengal, his mother made a living by taking care of a household and their cow. For feeding the cow, Radha used to take the cow to the land near a local primary school.

When the teacher taught in school, Radha used to listen from outside. One day the school inspector came to visit the school from the city. He asked some questions of the students after entering the class. Everyone was silent. Radha said from outside the classroom window…. “I know the answer to all your questions.” And he answered all the questions one by one. Inspector said… “Wonderful! Which class do you read?”

The answer came, “… I do not read…I graze a cow.”

Everyone was shocked to hear that. Calling the head teacher, the school inspector instructed the boy to take admission in school as well as provide some stipend.

This is how education of Radha Binod Pal started. Then after passing the school final with the highest number in the district, he was admitted to Presidency College. After taking M Sc. from the University of Calcutta, he studied law again and got the Doctorate title. In the context of choosing the opposite of two things he once said, “law and mathematics are not so different after all.”

Coming back again to the International Court of Tokyo.

In his convincing argument to the rest of the jurists he signified that the Allies, (winners of WWII), also violated the principles of restraint and neutrality of international law. In addition to ignoring Japan’s surrender hints, they killed two hundred thousand innocent people using nuclear bombardment.

The judges were forced to drop many of the accused from Class-A to B, after seeing the logic written on twelve hundred thirty-two pages by Radha Binod Pal. These Class-B war criminals were saved by him from a sure death penalty. His verdict in the international court gave him and India a world-famous reputation.

Japan respects this great man. In 1966 Emperor Hirohito awarded him the highest civilian honor of the country, ‘Kokko Kunsao’. Two busy roads in Tokyo and Kyotto have been named after him. The law has been included in the syllabus of his sentence. In front of the Supreme Court of Tokyo, his statue has been placed. In 2007, Prime Minister Shinzo Abe expressed his desire to meet his family members in Delhi and met his son.

Dr. Radha Binod Pal (27 January 1886 – 10 January 1967) name is remembered in the history of Japan. In Tokyo, Japan, he has a museum and a statue in Yasukuni shrine.

Japan University has a research center in his name. Because of his judgment on Japanese war criminals, Chinese people hate him.

He is the author of many books related to law. In India, almost nobody knows him and perhaps not even his neighbors know him! A Hindi movie was made on him, Tokyo Trials, starring Irfan Khan but that movie never made headlines.

….just one of the many underrated & unknown Indians.

*न्याय की चौखट पर शाहीनबाग धरना*

★ देश की राजनीति में अराजक व शरारती तत्वों की बढ़ती सक्रियता हमारी लोकतांत्रिक व संवैधानिक व्यवस्था को आहत करने वाली है। लोकसभा व राज्यसभा से क्रमशः 9 व 11 दिसम्बर 2019 को पारित एवं 12 दिसम्बर को महामहिम राष्ट्रपति जी द्वारा स्वीकृत होने के बाद विधिवत कार्यरूप में आने वाले “नागरिकता संशोधन अधिनियम” का विरोध करने के लिए जिस प्रकार शाहीन बाग (दिल्ली) के समान देश के अनेक नगरों में धरना प्रदर्शन हुए थे उससे देश के राजनैतिक भविष्य पर आने वाले संकट को अवश्य समझना होगा।

★ माननीय सर्वोच्च न्यायालय के शाहीन बाग धरने से सम्बंधित लगभग आठ माह पश्चात 7 अक्टूबर को दिए गए निर्णय को इतना अधिक सरल बना दिया जैसे मानो उसमें कोई कानून का उल्लंघन ही नहीं हुआ हो। शीर्ष न्यायालय का यह कथन सर्वाधिक न्यायसंगत है कि सार्वजनिक स्थलों पर अनिश्चितकालीन कब्जा स्वीकार नहीं और दिल्ली पुलिस को धरना स्थल को खाली कराने के लिए कार्यवाही करनी चाहिये थी। लेकिन उपरोक्त दोनों ही स्थिति में असफल होने के उपरांत ही तो इस पर न्याय की अपेक्षा से न्यायालय में याचिकाकर्ताओं को जाने के लिए विवश होना पड़ा था।

★ इस अधिनियम के मूल बिंदुओं को भ्रमित करके उकसाने वाले नेताओं और संगठनों का क्या कोई दोष नहीं था? क्या किसी ने यह जानने का साहस किया कि धरना स्थल पर हज़ारों बच्चों, महिलाओं व पुरुषों को आंदोलन के लिए एकत्रित करके उनपर लाखों- करोड़ों रुपयों का प्रबंध करने वाली कौनसी शक्तियां सक्रिय थी? क्या समाचारों में धरने से पूर्व कांग्रेस की रैली में हुए बड़े नेताओं के उत्तेजक भाषणों, जामिया व जेएनयू विश्वविद्यालय के छात्रों व जामिया नगरवासियों आदि की सक्रियता का संदिग्ध बताया जाना दोषपूर्ण था।

★ इस धरने में कुछ संगठनों जैसे पी.एफ.आई. व एस.डी.पी.आई. आदि की भी संलिप्तता का समाचार पत्रों से ज्ञात होता रहा परंतु न्याय की चौखट पर अभी तक इनमें कोई दोष नहीं पाया जाना अवश्य निराशाजनक है। जबकि पापुलर फ्रंट ऑफ इंडिया (पीएफआई) का तो कार्यालय भी शाहीन बाग क्षेत्र में ही आता है। क्या शरजील इमाम के अनेक स्थानों पर देश विरोधी भाषणों का इस बहुचर्चित व बहुबाधक धरने से कोई संबंध नहीं था?

★ इसलिये सौ दिन (15.12.2019 से 24.3.2020) से अधिक सार्वजनिक क्षेत्र को बंधक बनाकर लाखों देशवासियों को उनकी दिनचर्या में बाधक व अरबों रूपयों की व्यापार में क्षति का कारण एवं संवैधानिक व्यवस्था को आहत करने वाले इस शाहीन बाग धरने को क्या एक आपराधिक कृत्य मानना अनुचित होगा? सर्वोच्च न्यायालय द्वारा 19 फरवरी को नियुक्त वार्ताकारों का असफल होने से क्या न्यायायिक प्रक्रिया आहत नहीं हुई थी?

★ क्या इस धरने के षड़यंत्रकारियों ने ही फरवरी के अंतिम सप्ताह में धरने के समानांतर दिल्ली में विभिन्न स्थानों पर हिंसा,आगजनी व साम्प्रदायिक दंगों की योजनाएं तैयार की थी? गोलियां, बन्दूकें, पिस्तोलें व गुलेलों आदि की सीमित मात्राओं के अतिरिक्त रोड़े, पत्थर,पेट्रोल, बोतल व तेजाब आदि को असिमित मात्राओं में मकान व स्कूल की छतों पर एकत्रित करवाने के पीछे क्या धरने के समर्थक अराजक तत्व नहीं होंगे? यह सोचा जाना चाहिये कि अमरीका के राष्ट्रपति डोनाल्ड ट्रंप के भारत आगमन के समय 23 फरवरी से 25 फरवरी तक दिल्ली को दंगों की आग में झोंक कर राष्ट्र की प्रतिष्ठा को अंतरराष्ट्रीय मंच पर धूमिल करने वाले कौन थे?

★ भारतीय उपमहाद्वीप के धार्मिक पीड़ितों के कल्याणार्थ बनें इस बहुप्रतीक्षित नागरिक संशोधन अधिनियम में भारतीय मुसलमानों का कोई विरोध नहीं फिर भी इनको भड़का कर विरोध प्रदर्शन व धरने द्वारा देश के वातावरण को दूषित करके अराजकता व दंगे फैलाने वाले दोषियों को देश के समक्ष उजागर करने से सम्भवतः न्यायायिक व्यवस्था की कठोरता का भय ऐसे तत्वों के लिए एक चेतावनी होगी। इसलिए न्यायपालिका के निर्णय का सम्मान करने के साथ-साथ हम उससे सम्यक न्याय की आशा भी करते हैं।

★ लेकिन यह बहुत दुर्भाग्यपूर्ण हुआ कि शासन, प्रशासन व शीर्ष न्यायालय द्वारा शाहीन बाग धरना स्थल को रिक्त कराने के सारे प्रयास विफल होने के बाद आंदोलनकारियों में कोरोना महामारी के भय व्याप्त होने से 24 मार्च को प्रशासन ने आवश्यक कार्यवाही करके इस स्थल को मुक्त कराया था। नि:संदेह देश में बढ़ती ऐसी राजनैतिक अराजकता पर अंकुश लगाने के आवश्यक प्रयास शासन व प्रशासन को समय रहते ही करने चाहिये। देश की अखंडता व संप्रभुता को चुनौती देने वाले राष्ट्रद्रोहियों के षड़यन्त्रों को जब तक कुचला नहीं जाएगा तब तक राष्ट्रद्रोही शक्तियों का दुःसाहस बढ़ता ही रहेगा।

★ चिंतन करना होगा कि “भारत तेरे टुकड़े होंगे”, “भारत की बर्बादी तक जंग जारी रहेगी”, “जिन्ना वाली आज़ादी”, “हम देखेंगे…” “हिंदुओं की कब्र खुदेगी ए.एम.यू. की धरती पर”…जैसे विषैले नारे लगाने वाले राष्ट्रद्रोहियों पर न्याय क्यों मौन रहता है?

क्या शाहीन बाग के धरने का लक्ष्य यह था कि अनेक देशविरोधी नारों के साथ-साथ देश के प्रधानमंत्री श्री नरेन्द्र मोदी व गृहमंत्री श्री अमित शाह की मृत्यु के लिए विष उगलने वाली भाषा छोटे-छोटे मासूम बच्चों के मुख में डाल कर उनमें भारत विरोध का अभी से बीज बो दिया जाय?

★ न्याय की चौखट पर शाहीनबाग धरने के पीछे छुपे ऐसे तत्वों की हिंसक व अहिंसक आपराधिक गतिविधियों का आंकलन अवश्य होना चाहिये। भारतीय लोकतंत्र में ऐसी चुनौतियों को स्वीकार किया जाना सर्वथा अनुचित व अवैधानिक होगा। लोकतांत्रिक व्यवस्था में ऐसे तत्व देश के समक्ष एक बड़ा संकट बन चुके हैं।

★ यह अत्यंत चिंताजनक है कि अभिव्यक्ति की स्वतंत्रता के नाम पर निरंतर विष वमन करने वाले देशद्रोहियों पर कोई कठोर कार्यवाही करने में शासन की सक्रियता अभी तक धीमी व सीमित है। सशक्त राष्ट्र निर्माण के लिए शासन व प्रशासन को ऐसी परिस्थितियों में अविलंब कठोर निर्णय लेने पड़ेंगे नहीं तो शाहीन बाग जैसे धरने-प्रदर्शन से मुक्ति पाने के लिए कोरोना जैसी महामारी की प्रतीक्षा कब तक करते रहेंगे?

अमेरिका से आयी बंगाल के बारे में ऐसी खौफनाक रिपोर्ट जिसने पूरी दुनिया में तहलका मचा दिया है

कभी भारतीय संस्कृति का प्रतीक माने जाने वाले बंगाल की दशा आज क्या हो चुकी है यह बात तो किसी से छिपी नहीं है. हिन्दुओं के खिलाफ साम्प्रदायिकदंगे तो पिछले काफी वक़्त से होना शुरू हो चुके हैं और अब तो हालात ये हो चुके हैं कि त्यौहार मनाने तक पर रोक लगाई जानी शुरू हो गयी है

मगर बंगाल पर मशहूर अमेरिकी पत्रकार जेनेट लेवी ने अब जो लेख लिखा है और उसमे जो खुलासे किये हैं, उन्हें देख आपके पैरों तले जमीन खिसक जायेगी

जेनेट लेवी का दावा है बंगाल जल्द बनेगा एक अलग इस्लामिक देश

जेनेट लेवी ने अपने ताजा लेख में दावा किया है कि कश्मीर के बाद बंगाल में जल्द ही गृहयुद्ध शुरू होने वाला है
जिसमे बड़े पैमाने पर हिन्दुओं का कत्लेआम करके मुगलिस्तान नाम से एक अलग देश की मांग की जायेगी यानी भारत का एक और विभाजन होगा और वो भी तलवार के दम पर और बंगाल की वोटबैंक की भूखी ममता बनर्जी की सहमति से होगा सब कुछ

जेनेट लेवी ने अपने लेख में इस दावे के पक्ष में कई तथ्य पेश किए हैं उन्होंने लिखा है कि “बंटवारे के वक्त भारत के हिस्से वाले पश्चिमी बंगाल में मुसलमानों की आबादी 12 फीसदी से कुछ ज्यादा थी जबकि पाकिस्तान के हिस्से में गए पूर्वी बंगाल में हिंदुओं की आबादी 30 फीसदी थी आज पश्चिम बंगाल में मुसलमानों की जनसंख्या बढ़कर 27 फीसदी हो चुकी है कुछ जिलों में तो ये 63 फीसदी तक हो गई है वहीँ दूसरी ओर बांग्लादेश में हिंदू 30 फीसदी से घटकर केवल 8 फीसदी ही है ”

बढ़ती हुई मुस्लिम आबादी को ठहराया जिम्मेदार

जेनेट ने ये लेख ‘अमेरिकन थिंकर’ मैगजीन में लिखा है
ये लेख एक चेतावनी के तौर पर उन देशों के लिए लिखा गया है जो मुस्लिम शरणार्थियों के लिए अपने दरवाजे खोल रहे हैं
जेनेट लेवी ने बेहद सनसनीखेज दावा करते हुए लिखा है कि किसी भी समाज में मुस्लिमों की 27 फीसदी आबादी काफी है कि वो उस जगह को अलग इस्लामी देश बनाने की मांग शुरू कर दें

उन्होंने दावा किया है कि मुस्लिम संगठित होकर रहते हैं और 27 फीसदी आबादी होते ही इस्लामिक क़ानून शरिया की मांग करते हुए अलग देश बनाने तक की मांग करने लगते हैं
पश्चिम बंगाल का उदाहरण देते हुए उन्होंने लिखा है कि ममता बनर्जी के लगातार हर चुनाव जीतने का कारण वहां के मुस्लिम ही हैं
बदले में ममता मुस्लिमों को खुश करने वाली नीतियां बनाती है

सऊदी से आने वाले पैसे से चल रहा जिहादी खेल?

जल्द ही बंगाल में एक अलग इस्लामिक देश बनाने की मांग उठने जा रही है और इसमें कोई संदेह नहीं कि सत्ता की भूखी ममता इसे मान भी ले
उन्होंने अपने इस दावे के लिए तथ्य पेश करते हुए लिखा कि ममता ने सऊदी अरब से फंड पाने वाले 10 हजार से ज्यादा मदरसों को मान्यता देकर वहां की डिग्री को सरकारी नौकरी के काबिल बना दिया है सऊदी से पैसा आता है और उन मदरसों में वहाबी कट्टरता की शिक्षा दी जाती है

ममता ने शुरू किया इस्लामिक शहर बसाने का प्रोजेक्ट जहां गैर मजहबी लोगों से नफरत करना सिखाया जाता है
उन्होंने लिखा कि ममता ने मस्जिदों के इमामों के लिए तरह तरह के वजीफे भी घोषित किए हैं मगर हिन्दुओं के लिए ऐसे कोई वजीफे नहीं घोषित किये गए
इसके अलावा उन्होंने लिखा कि ममता ने तो बंगाल में बाकायदा एक इस्लामिक शहर बसाने का प्रोजेक्ट भी शुरू किया है

पूरे बंगाल में मुस्लिम मेडिकल, टेक्निकल और नर्सिंग स्कूल खोले जा रहे हैं
जिनमें मुस्लिम छात्रों को सस्ती शिक्षा मिलेगी
इसके अलावा कई ऐसे अस्पताल बन रहे हैं जिनमें सिर्फ मुसलमानों का इलाज होगा
मुसलमान नौजवानों को मुफ्त साइकिल से लेकर लैपटॉप तक बांटने की स्कीमें चल रही है
इस बात का पूरा ख्याल रखा जा रहा है कि लैपटॉप केवल मुस्लिम लड़कों को ही मिले मुस्लिम लड़कियों को नहीं

जेनेट ने मुस्लिमों को आतंकवाद का दोषी ठहराया
जेनेट लेवी ने लिखा है कि बंगाल में बेहद गरीबी में जी रहे लाखों हिंदू परिवारों को ऐसी किसी योजना का फायदा नहीं दिया जाता है
जेनेट लेवी ने दुनिया भर की ऐसी कई मिसालें दी हैं जहां मुस्लिम आबादी बढ़ने के साथही आतंकवाद धार्मिक कट्टरता और अपराध के मामले बढ़ने लगे

आबादी बढ़ने के साथ ऐसी जगहों पर पहले अलग शरिया क़ानून की मांग की जाती है और फिर आखिर में ये अलग देश की मांग तक पहुंच जाती है
जेनेट ने अपने लेख में इस समस्या के लिए इस्लाम को ही जिम्मेदार ठहरा दिया है
उन्होंने लिखा है कि कुरान में यह संदेश खुलकर दिया गया है कि दुनिया भर में इस्लामिक राज स्थापित हो.

तस्लीमा नसरीन का उदाहरण किया पेश

जेनेट ने लिखा है कि हर जगह इस्लाम जबरन धर्मपरिवर्तन या गैरमुसलमानों की हत्याएं करवाकर फैला है
अपने लेख में बंगाल के हालातों के बारे में उन्होंने लिखा है
बंगाल में हुए दंगों का जिक्र करते हुए उन्होंने लिखा है कि 2007 में कोलकाता में बांग्लादेशी लेखिका तस्लीमा नसरीन के खिलाफ दंगे भड़क उठे थे
ये पहली कोशिश थी जिसमे बंगाल में मुस्लिम संगठनों ने इस्लामी ईशनिंदा (ब्लासफैमी) कानून की मांग शुरू कर दी थी

भारत की धर्म निरपेक्षता पर उठाये सवाल

1993 में तस्लीमा नसरीन ने बांग्ला देश में हिंदुओं पर हो रहे अत्याचारों और उनको जबरन मुसलमान बनाने के मुद्दे पर किताब ‘लज्जा’ लिखीथी
किताब लिखने के बाद उन्हें कट्टर पंथियों के डर से बांग्लादेश छोड़ना पड़ा था
वे कोलकाता में ये सोच कर बस गयी थी कि वहां वो सुरक्षित रहेंगी क्योंकि भारत तो एक धर्मनिरपेक्ष देश है और वहां विचारों को रखने की स्वतंत्रता भी है

मगर हैरानी की बात यह है कि धर्म निरपेक्ष देश भारत में भी मुस्लिमों ने तस्लीमा नसरीन को नफरत की नजर से देखा
भारत में उनका गला काटने तक के फतवे जारी किए गए
देश के अलगअलग शहरों में कई बार उन पर हमले भी हुए
मगर वोटबैंक के भूखी वामपंथी और तृणमूल की सरकारों ने कभी उनका साथ नहीं दिया क्योंकि ऐसा करने पर मुस्लिम नाराज हो जाते और वोटबैंक चला जाता

बंगाल में हो रही है ‘मुगलिस्तान’ देश की मांग

जेनेट लेवी ने आगे लिखा है कि 2013 में पहली बार बंगाल के कुछ कट्टरपंथी मौलानाओं ने अलग ‘मुगलिस्तान’ की मांग शुरू कर दी थी
इसी साल बंगाल में हुए दंगों में सैकड़ों हिंदुओं के घर और दुकानें लूट लिए गए और कई मंदिरों को भी तोड़ दिया गया
इन दंगों में सरकार द्वारा पुलिस को आदेश दिये गए कि वो दंगाइयों के खिलाफ कुछ ना करें

हिन्दुओं का बहिष्कार किया जाता है?

ममता को डर था कि मुसलमानों को रोका गया तो वो नाराज हो जाएंगे और वोट नहीं देंगे
लेख में बताया गया है कि केवल दंगे ही नहीं बल्कि हिन्दुओं को भगाने के लिए जिन जिलों में मुसलमानों की संख्या ज्यादा है, वहां के मुसलमान हिंदू कारोबारियों का बायकॉट करते हैं.
मालदा, मुर्शिदाबाद और उत्तरी दिनाजपुर जिलों में मुसलमान हिंदुओं की दुकानों से सामान तक नहीं खरीदते हैं

यही वजह है कि वहां से बड़ी संख्या में हिंदुओं का पलायन होना शुरू हो चुका है
कश्मीरी पंडितों की ही तरह यहाँ भी हिन्दुओं को अपने घरों और कारोबार छोड़कर दूसरी जगहों पर जाना पड़ रहा है
ये वो जिले हैं जहां हिंदू अल्पसंख्यक हो चुके हैं

आतंकी समर्थकों को संसद भेज रही ममता

इसके आगे जेनेट ने लिखा है कि ममता ने अब बाकायदा आतंकवाद समर्थकों को संसद में भेजना तक शुरू कर दिया है

जून 2014 में ममता बनर्जी ने अहमद हसन इमरान नाम के एक कुख्यात जिहादी को अपनी पार्टी के टिकट पर राज्यसभा सांसद बनाकर भेजा
हसन इमरान प्रतिबंधित आतंकी संगठन सिमी का सहसंस्थापक रहा है

हसन इमरान पर आरोप है कि उसने शारदा चिटफंड घोटाले का पैसा बांग्लादेश के जिहादी संगठन जमात ए इस्लामी तक पहुंचाया ताकि वो बांग्लादेश में दंगे भड़का सके
हसन इमरान के खिलाफ एनआईए और सीबीआई की जांच भी चल रही है

लोकल इंटेलिजेंस यूनिट एलआईयू की रिपोर्ट के मुताबिक कई दंगों और आतंकवादियों को शरण देने में हसन का हाथ रहा है

उसके पाकिस्तानी खुफिया एजेंसी आईएसआई से रिश्ते होने के आरोप लगते रहे हैं
जेनेट के मुताबिक़ बंगाल का भारत से विभाजन करने की मांग अब जल्द ही उठने लगेगी
इस लेख के द्वारा जेनेट ने उन पश्चिमी देशों को चेतावनी दी है जो मुस्लिम शरणार्थियों को अपने यहाँ बसा रहे हैं कि जल्द ही उन्हें भी इसी सब का सामना करना पडेगा जैसे जर्मनी और इंग्लै

Islam:
