Extreme victimization of a woman renunciant in a conspiracy to craft fiction of “Hindu Terrorism”
(‘Hindu Terrorism” is an oxymoron. – Suresh Vyas)
Sadhvi  Pragya’s interview with Rajat Sharma on an Indian TV show “Aap Ki Adalat ” has stirred the whole humanity. This story of mindless violation of a woman’s rights needs to reach every human being. This crime of depriving a citizen of her rights needs to be condemned by all courts of law. These words of extreme cruelty need to be heard by the open minds of 21st century.

She was arrested on fictitious charges of plotting a conspiracy to carry out Malegaon blasts of September 2008 in the Malegaon region of Nashik district of Maharashtra that had left 4 dead and around 80 injured.

She is not free. She can never live the same life again. She is in extreme pain and she is half-free from the accusation of the crime she never did. She got bail on April 25 2017. She suffered the most inhuman torture for eight years while she could have got bail within half hour back in 2008 on legal grounds. She is a victim of prejudiced minds. Minds that want to make anyone think that any Hindu wearing orange colored clothes  is a criminal. The arrest of Sadhvi Pragya among others was used by the Congress party to fan the theory of “Hindu Terrorism”. Even some members of UPA stated this was an elaborate ploy organized by senior members of the UPA administration. This case was prejudiced by media. Media published articles like ‘Indian Muslims will lose faith in democracy if Sadhvi Pragya walks free’.

On TV, Sadhvi explained the manner in which she was tortured and abused by government officials. She was brutally beaten by male officers with a broad expeller belt, day and night for more than three weeks. Her arms and legs were swollen, which were then immersed in salty warm water, and the beatings resumed. Filthy abuses were turned at her. She was forced to hear objectionable CDs. She was manhandled so she could make a wrong statement of “confession”. This was done in an attempt to implicate senior RSS leaders. Sadhvi also mentioned that she was tortured through sleep deprivation as well which caused her to experience immense psychological trauma as a consequence.

There is no credible evidence that could prove that Sadhvi owned the motorcycle at time of the blast. It is super-ridiculous that police diary entry mentioned the motorcycle was owned by Sadhvi before the motor cycle company gave estimated registration numbers to police for investigation around ownership.

The lead counsel who represented her, Avinash Gupta, proves Sadhvi is innocent and it is tragic she had to see eight years of extreme animal behavior of policemen. Her appeals of bail were repeatedly rejected even though NIA  had failed to find conclusive evidence against her. The fourth appeal rejected in trial court was challenged by Avinash in High court. On studying the facts, Avinash wondered why she did not get bail within half an hour in the first instance itself as Sadhvi met all the criteria needed.

Nashik Rural Police found that a fake number plate was used to ascertain ownership. On 7 October 2008, Forensic Science Laboratory (FSL) at Nashik said that they were unable to decipher the chassis number. Three possible engine numbers were forwarded to the motorcycle manufacturing company LML. After about a month, in November, LML said that they did not manufacture any of those three numbers but gave two closely matching numbers. One of which was linked to the motorcycle Sadhvi once owned. All this is not considered reliable evidence since these were based on only estimations. Also, the station diary entry of the police mentioned the registration number belonging to Sadhvi on 11 October 2008. LML gave closing matching numbers in November 2008. This means this was a ploy.

ATS  tortured innocent individuals to give wrong statements about the hatching of conspiracy. Some of them even approached National Human Rights Commission (NHRC) with their complaint against the ATS. There is no institutional involvement of any organization or a big figure. However, on the other side it is heard that there is a big fund running in the range of over 100 crore rupees that is used to defend people who are suspected to have been wrongly accused of terror charges based on their religion. Sadhvi did not have any such institutional support.

The case was transferred from ATS to NIA in 2011, when Congress was in power in both Maharashtra as well as in center. There were two blast cases in Malegaon. First in 2006 where a Muslim connection was found approved by ATS. NIA rejected this and implicated Hindus. The same NIA is questioned in Sadhvi’s case today. Why is it very difficult to accept that this was a ploy?
The next few sentences attempt to summarize her infinite pain. To begin with, she was called by ATS to come to Surat to help law and give information about a motorcycle. She was then illegally taken to Mumbai. She was physically and mentally tortured for 13 days in an obscene way. She was surrounded by men and beaten. She was then taken to hotel  and was beaten so badly that her lungs got damaged and she had to be given oxygen for five days. She was secretively moved from one hospital to another during this time. As soon as she was a little better she was sent back to the same place and the same brutal beating continued. She was then taken to Nasik after 13 days and then was shown arrested. She had not eaten anything. Her mouth was tied and she tolerated persistent beatings. She was broken by then. While she was faint her clothes of renunciation (orange clothes) were removed and she was made to wear salwar-kameez . This is a grave insult for a woman renunciant. Without any permission she had to go through Narco-test, Polygraph test, and brain mapping. These tests were repeated after declaring her arrested. With all this beating she has multiple injuries. Her spine is injured. She is unable to sit and stand comfortably. She was given eggs to eat during fifth year of imprisonment in Mumbai. She developed breast cancer. She was taken to various hospitals but she was never given any suitable treatment. She was operated for breast cancer in 2009. She again had some issue in 2010. After removal of MCOCA  she was in Nasik jail. She was sent to a district hospital. Doctors recommended a surgery again. But after MCOCA she was again taken to Mumbai. Since march 2012 she was in Madhya Pradesh’s Bhopal jail. Even though jail administration wanted her to get treatment police officers humiliated her. She came back from the hospital without getting any treatment a number of times. Situations were made in a way that no hospital wanted giver her suitable treatment. She then decided to refuse to go for any fake treatments. She only resorted to Yoga and Pranayam  in the darkness of captivity.
She could not live a normal life either as a prisoner, as a woman, or as a citizen of India. She used to live as a woman renunciant. Her values, her daily chores, and her promises to be kept as a renunciant everything had to face obscene captivity and torture. Today she is asking humanity what should she do. How should she live her life with the same pride and dignity?

We request the Prime Minister of India to please answer her questions so she finds some solace and comes of the emotional, physical, and spiritual trauma. She cannot walk on her legs but with the support of humane values she can still raise her head high with self-respect which was beaten ruthlessly for eight endless years.

वर्षों तक एक विचाराधीन कैदी साध्वी प्रज्ञा को पुरुष पुलिस अधिकारियों व कर्मचारियों द्वारा कठोरतम मानसिक व शारीरिक पीड़ा देना मानवाधिकार व न्याय व्यवस्था का खुला उल्लंघन है। ध्यान रहे कि इनको 13 दिन विभिन्न कठोर यातनाएं देने के बाद बंदी बनाया दिखाया गया था। इसके अतिरिक्त साध्वी जी के नारको, पोलीग्राफी व ब्रेन मैपिंग टेस्ट बिना न्यायालय की अनुमति के हुए व बंदी बनाने के बाद भी यह तीनों टेस्ट पुनः किये गये थे। सम्भवतः ऐसा विश्व इतिहास में पहली बार किसी विचाराधीन दोषी के साथ हुआ होगा।

क्यों नहीं ऐसे क्रूरतम कांड के जिम्मेदार सरकारी व राजनैतिक दोषियों पर सर्वोच्च न्यायालय संज्ञान लेता ? ऐसा अगर किसी मुस्लिम या ईसाई के साथ होता तो सेक्युलर व मानवाधिकारवादी मंडली अब तक भारत सरकार को कटघरे में खड़ा कर चुकी होती।

लेकिन हिंदुओं की उदारता उन्हें कायर बनाये रखती है। स्वार्थ वश वे किसी न किसी राजनेता के अंधभक्त बनने को विवश होते रहते हैं। इसी कारण धार्मिक प्रेरणा के ओझल होने से उनमें स्वाभिमान व तेजस्विता का निरन्तर अभाव होता जा रहा है।अपवादस्वरूप साध्वी प्रज्ञा सिंह ठाकुर जैसे धर्म योद्धाओं की जिजीविषा को तोड़ा जाता है। उनका मानमर्दन करके उनको इतना उत्पीडित किया जाता है कि भविष्य में अन्य कोई ऐसा साहस ही न कर सकें।

सूर्य के समान सम्पूर्ण भूमंडल के अंधकार को दूर कर देने वाला भगवा सभी को धर्मांधों से धर्म रक्षा की प्रेरणा देता है। ध्यान रहे कि भगवाधारी का विचार और चिंतन किसी आग्नेयास्त्र से कम नही होता। साध्वी प्रज्ञा ने यह प्रमाणित कर दिया कि उनका एक एक शब्द हिन्दू चेतना का प्रतीक है।

क्या कारण है कि किसी मुसलमान व ईसाई सजायाफ्ता अपराधियों के साथ भी ऐसे दर्दनाक उत्पीडन का शासकीय व प्रशासकीय आधिकारियों में साहस नही होता ? आपको स्मरण होगा कि 26.11.2008 मुम्बई को लगभग 60 घंटे तक बंधक बनाने वाले आतंकवादी हमलों में पकड़ा गया अजमल कसाब को स्वादिष्ट व्यंजन परोसने में अधिकारियों ने कोई कसर नहीं छोड़ी थी। यद्दपि कालांतर में उसे उसके जिहादी अपराधों पर फांसी दी गई।

लेकिन चिंतन करना होगा कि निर्दोष धर्माचार्या का अपमान व उत्पीडन करने वाले अधिकारी (मृत्युपरांत) हेमंत करकरे व उनके साथी क्षमा योग्य कैसे हो सकते हैं ? जबकि आतंकवादियों के लिए (सितंबर 2008) यमराज बनें शहीद मोहनचंद शर्मा के बलिदान पर गर्व करने के स्थान पर उनकी वीरता पर संदेह करके आतंकियों को उत्साहित करने वालों की देशभक्ति पर संदेह अवश्य होता है।

अतः आज देश की बर्बादी तक जंग करके टुकड़े-टुकड़े करने की देशद्रोही मानसिकता वाले और उनके सहयोगियों को ढूंढ -ढूंढ कर कारागारों में डालना होगा और साध्वी प्रज्ञा जैसे भारतीय अस्मिता व स्वाभिमान के लिए संघर्ष करने वालों से प्रेरणा लेकर राष्ट्रोत्थान में भागीदार बनना होगा।

The conspiracy within the judicial system exposed: Is there not an urgent need to enquire why the Chidambarams are being prevented from being arrested?

I was offered bribe to help frame CJI in the sexual harassment case by lawyering and organizing a Press Conference against the CJI for the Ex SC staffer who has accused the CJI of sexual harassment just a few days back, and also specifically (was) asked to organize a press conference only at the Press Club of India.

When I refused, the person who was initially praising my pro bono work in the Asaram Rape case for the victim etc. and interestingly claimed to be her relative (but on the other hand looked like a trained agent and he also) couldn’t satisfactorily reply as to what was his relationship with the Ex SC Staffer, and then suddenly offered me 50 lacs as my legal fees if I agreed to lawyer; and again he asked me specifically to organize a press conference at the PCI after I refused as I found the story facts fishy. Also, he couldn’t reply to any question about the many loopholes in the story he narrated. When I again refused, he said 1.5 Cr. I then asked him to leave my office.

I then enquired more about this issue from reliable sources in Delhi for days, every information pointed to a larger conspiracy to make the CJI resign; and kingpin of which are many Delhi based SC fixers or those who engage in cash for Judgements.

I was convinced about a well-planned conspiracy after days of getting such credible information.

I then finally went to CJI residence yesterday evening around 7 pm to inform him about the bribe offer and the conspiracy, but his staff said he’s not at his residence. My CDR tower location details can be checked.

Later at night I then called a SC reporter with impeccable proven integrity to meet me today for an important subject, and also asked him if he could arrange a urgent meeting or get a message sent to the CJI ASAP. I had also today morning planned to meet Prashant Bhushan Sir and Kamini Jaiswal madam about this.

But then today morning my perception turned out to be true.

After hours of ponder and soul searching, I have decided to speak the truth and file a detailed affidavit in this regard in the SC along with evidences of the conspiracy against the CJI by a lobby of disgruntled judges, SC fixers, corporate scamsters and a few corrupt Politicians – all who have meticulously planned the conspiracy to force the CJI to resign as their ‘Corrupt works were not going through in SC.

After today, I will not be appearing in any case in the court of the CJI. Also, I have never personally interacted with the CJI or anyone close to him. My electronic records etc. are open to any independent scrutiny. I will leave legal practice if anyone can prove that I have associated or even interacted ever with CJI outside the Court room. As a matter of principle, I don’t butter or bootlick judges.

I was stopped to go public by some senior well-wishers, and (was) told that the lobby of judges who is planning this conspiracy will turn against me, and harm me professionally. But my conscious doesn’t allow me to turn my face away, and let history record today’s day as the darkest day in the history of SC.

I moved to Delhi from Chandigarh as I refused to be institutionalized in judicial nepotism. My grandfather is a retired HC judge who appointed many HC judges, and my father (is) a senior lawyer, many of his friends or my family friends are HC Judges at PB HRY HC – (which) Precisely (is) the reason why I moved to lawyer in Delhi.

In SC until now I have only associated in SC with the likes of Prashant Bhushan and Kamini Jaiswal and with Anupam Gupta in PB HRY HC who all are known for standing fearlessly against financially corrupt and morally corrupt judges, and against judicial nepotism.

I have till date never associated with any kin or kith of SC judges as principle of having a clean legal practice, and (I always have) refused to be institutionalized in nepotism or be a member of the uncle judges young lawyer club.

किताबों को खंगालने से हमें यह पता चला कि ‘बनारस हिन्दू विश्वविद्यालय‘ (BHU) के संस्थापक पंडित मदनमोहन मालवीय जी नें 14 फ़रवरी 1931 को Lord Irwin के सामने भगत सिंह, राजगुरु और सुखदेव की फांसी रोकने के लिए Mercy Petition दायर की थी ताकि उन्हें फांसी न दी जाये और कुछ सजा भी कम की जाएl Lord Irwin ने तब मालवीय जी से कहा कि आप कांग्रेस के पूर्व अध्यक्ष है इसलिए आपको इस Petition के साथ नेहरु, गाँधी और कांग्रेस के कम से कम 20 अन्य सदस्यों के पत्र भी लाने होंगेl

जब मालवीय जी ने भगत सिंह की फांसी रुकवाने के बारे में नेहरु और गाँधी से बात की तो उन्होंने इस बात पर चुप्पी साध ली और अपनी सहमति नहीं दीl इसके अतिरिक्त गाँधी और नेहरु की असहमति के कारण ही कांग्रेस के अन्य नेताओं ने भी अपनी सहमति नहीं दीl

Retire होने के बाद Lord Irwin ने स्वयं London में कहा था कि “यदि नेहरु और गाँधी एक बार भी भगत सिंह की फांसी रुकवाने की अपील करते तो हम निश्चित ही उनकी फांसी रद्द कर देते, लेकिन पता नहीं क्यों मुझे ऐसा महसूस हुआ कि गाँधी और नेहरु को इस बात की हमसे भी ज्यादा जल्दी थी कि भगत सिंह को फांसी दी जाए”

Prof. Kapil Kumar की किताब के अनुसार ”गाँधी और Lord Irwin के बीच जब समझौता हुआ उस समय इरविन इतना आश्चर्य में था कि गाँधी और नेहरु में से किसी ने भगत सिंह, राजगुरु और सुखदेव को छोड़ने के बारे में चर्चा तक नहीं कीl”

Lord Irwin ने अपने दोस्तों से कहा कि ‘हम यह मानकर चल रहे थे कि गाँधी और नेहरु भगत सिंह की रिहाई के लिए अड़ जायेंगे और हम उनकी यह बात मान लेंगेl

भगत सिंह, सुखदेव और राजगुरु को फांसी लगाने की इतनी जल्दी तो अंग्रेजों को भी नही थी जितनी कि गाँधी और नेहरु को थी क्योंकि भगत सिंह तेजी से भारत के लोगों के बीच लोकप्रिय हो रहे थे जो कि गाँधी और नेहरु को बिलकुल रास नहीं आ रहा था l यही कारण था कि वो चाहते थे कि जल्द से जल्द भगत सिंह को फांसी दे दी जाये, यह बात स्वयं इरविन ने कही हैl

इसके अतिरिक्त लाहौर जेल के जेलर ने स्वयं गाँधी को पत्र लिखकर पूछा था कि ‘इन लड़कों को फांसी देने से देश का माहौल तो नहीं बिगड़ेगा?‘ *तब गाँधी ने उस पत्र का लिखित जवाब दिया था कि ‘आप अपना काम करें कुछ नहीं होगाl’ इस सब के बाद भी यादि कोई कांग्रेस को देशभक्त कहे तो निश्चित ही हमें उसपर गुस्सा भी आएगा और उसकी बुद्धिमत्ता पर रहम भी।
